Israeli Knesset Approves Death Penalty Law for Palestinian Prisoners Amid Widespread Protests

The Israeli Knesset passed a law Wednesday authorizing the death penalty for Palestinian prisoners by a vote of 62 to 58, a measure championed by far-right coalition partners that drew immediate condemnation from Arab governments, human rights organizations, and Palestinian leaders who called it a dangerous escalation and a direct assault on international humanitarian law.

The bill, driven by far-right Finance Minister Bezalel Smotrich and National Security Minister Itamar Ben Gvir, passed after sustained pressure from ultranationalist parties within Prime Minister Benjamin Netanyahu's governing coalition. The legislation allows Israeli military courts to impose capital punishment on Palestinians convicted of what Israeli authorities classify as terror offenses resulting in death — a definition Palestinian and international legal experts say is applied almost exclusively to Palestinians under occupation.

The vote triggered a general strike across the occupied West Bank, with schools, businesses, and government institutions shutting down in protest. Clashes erupted in several cities between Palestinian demonstrators and Israeli security forces, with injuries reported in Ramallah, Nablus, and Hebron. The Palestinian Authority condemned the law as a war crime and a flagrant violation of the Fourth Geneva Convention, which prohibits occupying powers from executing prisoners under their control.

The Palestinian Authority called for an emergency session of the Arab League, urging member states to adopt a unified diplomatic response and refer the matter to the United Nations Security Council. Jordan, Egypt, and Saudi Arabia issued formal condemnations, with Amman summoning the Israeli chargé d'affaires to lodge an official protest.

Qatar, which has served as the principal mediator in Gaza ceasefire negotiations between Hamas and Israel, issued a strongly worded statement through its Ministry of Foreign Affairs, describing the law as a grave violation of international humanitarian law and a deliberate provocation that undermines any remaining prospect for a negotiated settlement. Doha called on the international community, particularly the permanent members of the Security Council, to hold Israel accountable and prevent the law from being implemented.

Amnesty International and Human Rights Watch characterized the legislation as targeting a specific national group and warned it could constitute a crime against humanity. Israeli opposition lawmakers and legal scholars also condemned the move, arguing it would deepen the country's international isolation and set a precedent that erodes the rule of law.

The European Union expressed deep concern, while a muted response from the United States State Department drew sharp criticism from Palestinian and Arab officials who described Washington's reaction as wholly inadequate. The law's passage comes as the death toll in Gaza has surpassed fifty thousand since the outbreak of war in October 2023, according to Gaza health authorities, deepening fears that the legislation signals an irreversible shift in Israel's approach to Palestinians under its control.

أقرّ الكنيست الإسرائيلي يوم الأربعاء قانوناً يُجيز تطبيق عقوبة الإعدام بحق الأسرى الفلسطينيين، وذلك بأغلبية 62 صوتاً مقابل 58، في خطوة دفعتها أحزاب اليمين المتطرف داخل الائتلاف الحكومي، فأثارت موجة إدانات عربية ودولية واسعة، فيما طالبت السلطة الفلسطينية بعقد اجتماع طارئ لجامعة الدول العربية.

جاء هذا القانون ثمرةً لضغوط مستمرة مارسها وزير المالية بتسلئيل سموتريش ووزير الأمن القومي إيتمار بن غفير، أبرز رموز التيار القومي المتطرف في حكومة رئيس الوزراء بنيامين نتنياهو. ويُتيح القانون للمحاكم العسكرية الإسرائيلية إصدار أحكام الإعدام بحق الفلسطينيين المُدانين بما تُصنّفه السلطات الإسرائيلية عمليات إرهابية أسفرت عن سقوط قتلى، وهو تصنيف يرى فقهاء القانون الدولي والفلسطينيون أنه يُطبَّق بصورة شبه حصرية على أبناء الشعب الفلسطيني الواقع تحت الاحتلال.

وفي أعقاب التصويت، اندلع إضراب شامل في أرجاء الضفة الغربية المحتلة، إذ أغلقت المدارس والمحال التجارية والمؤسسات الحكومية أبوابها تضامناً مع الأسرى، واشتعلت مواجهات في عدد من المدن بين المحتجين الفلسطينيين وقوات الاحتلال الإسرائيلي، مع الإبلاغ عن إصابات في رام الله ونابلس والخليل. ووصفت السلطة الفلسطينية هذا القانون بأنه جريمة حرب وانتهاك صريح لاتفاقية جنيف الرابعة التي تحظر صراحةً على قوات الاحتلال إعدام الأسرى الخاضعين لسيطرتها.
