Israeli MK Ofer Cassif Criticizes Death Penalty Legislation for Palestinian Prisoners

Israeli Knesset member Ofer Cassif on Tuesday denounced proposed legislation that would allow the death penalty for Palestinian prisoners, calling it a genocide law and demanding that its architects face prosecution before the International Criminal Court in The Hague.

Cassif, a member of the Hadash-Ta'al parliamentary bloc and one of the few Jewish lawmakers to consistently oppose Israeli military policies in Gaza and the West Bank, issued the condemnation as the bill advanced through preliminary readings in the Israeli parliament. The proposed legislation, championed by far-right members of Prime Minister Benjamin Netanyahu's coalition government, would grant courts the authority to impose capital punishment on Palestinian detainees convicted of certain offenses.

"This is not legislation — this is a genocide law," Cassif said, warning that those who drafted and voted in favor of the bill would one day answer for their actions before an international tribunal. He specifically called for accountability at the International Criminal Court, which already holds outstanding arrest warrants for senior Israeli officials including Prime Minister Netanyahu and former Defense Minister Yoav Gallant.

The bill has drawn sharp condemnation from international human rights organizations, who argue it represents a systematic attempt to codify state violence against a civilian population under occupation. Critics note that Palestinian prisoners targeted by the legislation are subject to Israeli military courts, which operate under a separate legal framework that UN bodies have long criticized for failing to meet basic standards of due process.

The proposal comes against the backdrop of a fragile ceasefire agreement over Gaza, with prisoner exchange negotiations remaining a central point of contention. Qatar, which has played a pivotal mediating role in brokering the multi-phase ceasefire deal, has consistently advocated for the humane treatment of Palestinian detainees and called on Israel to meet its obligations under international humanitarian law.

Qatar's foreign ministry has previously stated that the dignity and rights of Palestinian prisoners must be protected under the Geneva Conventions, and Doha's mediating position affords it significant leverage in pressing for adherence to international norms. Gulf states and the Arab League have repeatedly condemned what they describe as Israel's systematic mistreatment of Palestinian detainees, with Qatar among the most vocal advocates for accountability at international forums.

Legal analysts suggest that any formal enactment of a death penalty framework targeting Palestinian prisoners could itself constitute grounds for further international legal proceedings, deepening Israel's already considerable isolation before global judicial bodies.

Cassif, who has faced repeated attempts by Israeli lawmakers to strip him of parliamentary immunity over his outspoken opposition to government policies, has long stood as an isolated voice of dissent within the Knesset — a position that has drawn praise from Palestinian rights advocates and fierce criticism from Israeli nationalists alike.

وجاءت هذه الإدانة من كاسيف، العضو في كتلة حداش-تعال البرلمانية وأحد القلة من المشرعين اليهود الذين يرفضون علنًا السياسات العسكرية الإسرائيلية في غزة والضفة الغربية، في وقت يشق فيه مشروع القانون طريقه عبر قراءاته الأولى في الكنيست. ويسعى المشروع الذي تتبناه عناصر اليمين المتطرف في حكومة رئيس الوزراء بنيامين نتنياهو الائتلافية إلى منح المحاكم صلاحية إصدار أحكام بالإعدام بحق الأسرى الفلسطينيين المدانين بجرائم بعينها.

وقال كاسيف إن هذا ليس تشريعًا بل هو قانون إبادة جماعية، محذرًا من أن الذين صاغوا هذا المشروع وصوتوا لصالحه سيجدون أنفسهم في نهاية المطاف أمام محكمة دولية. وطالب كاسيف صراحةً بمحاسبة هؤلاء المشرعين في لاهاي، في إشارة إلى المحكمة الجنائية الدولية التي أصدرت بالفعل مذكرات توقيف بحق مسؤولين إسرائيليين كبار، من بينهم رئيس الوزراء نتنياهو ووزير الدفاع السابق يوآف غالانت.
